Thank you for purchasing our Cash Practice Webinar and Membership Program!

By purchasing and accessing services on our site, you are agreeing to our Website Terms of Use and Privacy Policy incorporated into this Agreement by reference.  You also agree to these additional terms outlined below.  If you do not agree with these Terms and Conditions, do not access our Webinar and Consultation package.

Webinar/Consult Package Description.  This is a 90-minute educational webinar on the legal analysis of Medicare Private Payment Issues as well as a discussion of other payment issues.  It includes HIPAA and other template forms that most cash practitioners need (“Webinar Content”).  “Webinar Content” means any and all written, visual, video, or audio information contained on the webinar or in the associated documents provided with it whether they are in a viewable, downloadable or access to a streaming form.

Membership Program.  Membership benefits include:

  • Member-only access to our library of recorded webinars, template forms and other resources on our Members-only pages of our website.
  • Member access to our live monthly webinars on the 3rd Thursday of each month.  We reserve the right to change the webinar schedule at our discretion.
  • Q & A by phone and email during the term of your membership.  We only charge for lengthy phone consultations or other legal work you ask us to do.
  • Discounted rates on our services, including our hourly rate  for services that go beyond the short Q & A or require work outside of our Q & A time (currently $250/hour with discount vs. $300/hour without discount)

License Grant.  By purchasing the webinar and/or Membership, we grant you a limited license, which is non-exclusive, non-transferable, and non-sublicensable, to access, view, and use the pages of our website that go with your purchase solely for your personal purposes. No Webinar or Website Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, modified or used for public or commercial purposes, or downloaded in any way unless written permission is expressly granted by us. Modification of the Webinar or Website Content or use of the Webinar or Website Content, including the documents and forms, for any other purpose is a violation of our copyright and other proprietary rights and may be subject to monetary damages and penalties.

Access to Content.  After we approve your registration, you will need to sign in as a Member with your Username and Password to access your content.  Member content may change from time to time, so we encourage you to revisit content you are interested in occasionally. Your membership access is for one year, then you must renew your membership to maintain access.  You may renew at our then current annual or monthly payment rate on the Membership Renewal page of our website.

Confidentiality.  You agree to maintain the confidentiality of your password and are fully responsible for all liability and damages resulting from your failure to maintain that confidentiality and all activities that occur through the use of your password.  You agree to immediately notify us of any authorized use of your password or any other breach of security.

Disclaimer.  The webinar and website content is intended to be educational and is not considered legal advice on its own. Therefore, you should not make decisions or take any actions or inactions based solely on the webinar or website content.

Consultation Disclaimer.  The individual consultation that follows the Cash Practice Webinar is intended to assist you in making decisions based on your own practice, including but not limited to whether to enroll with or continue as a Medicare participating or non-participating provider or unenroll, whether you will see Medicare patients who want to pay you privately for their covered or non-covered services, and what other policies you might need to put in place.  It is important for you to understand that the information in our webinar is based on our interpretation and analysis of the Medicare statutes, regulations and case law we reviewed.  There are unanswered questions in the case law, therefore, our analysis and opinion may change if new information becomes available or new case law is subsequently published.  Our intent is to advise you on the potential risks and how to minimize your risks if you decide to accept private payment from a Medicare beneficiary.  We do not claim that our advice will eliminate all potential legal and compliance risks, especially if you do not follow our advice or your patients try to submit their own claims to Medicare even though they agreed, of their own free will in writing, that they would not do so.  Therefore, you assume all risks, if any, if you choose to accept private payment from Medicare beneficiaries for covered or non-covered services whether you are enrolled as a Medicare provider or not.

Q & A Benefit. Your membership entitles you to free phone and email contact with us any time you have questions.  No question is too dumb to ask!  We can answer general practice management and federal law questions.  If your question requires consultation with an attorney in your state, we will let you know and may be able to refer you to someone.  If your question or issue requires research or lengthy consultation and we have to bill you for our time, we will let you know in advance.

Right to Terminate.  We reserve the right to limit your access to the Members-only pages and the Webinar Content should the we determine, in our sole discretion, that you have violated any of the prohibited uses or any other terms in this Agreement.

Refunds.  We do not provide refunds once access to the Membership and Webinar Content has been made available to you.
