By purchasing the Cash Practice Payment Issues webinar and consultation, you are agreeing to our Website Terms of Use and Privacy Policy incorporated into this Agreement by reference.  You also agree to the Webinar Terms & Conditions (collectively “Legal Terms”).  If you do not agree with these Legal Terms, contact us for a full refund before you access the Content.  No refunds will be made if you have accessed the Content page and you will be bound by the collective Legal Terms.  

Webinar/Consult Package Description and Access.  Your purchase includes a 90-minute educational webinar on the legal analysis of Medicare Private Payment Issues as well as a discussion of other payment issues.  You will also be given access to several HIPAA and other template forms that most cash practitioners need (“Webinar Content”).  “Webinar Content” means any and all written, visual, video, or audio information contained on the webinar or in the associated documents provided with it whether they are in a viewable, downloadable or access to a streaming form.

You will be given access to the Webinar Content through a “Members-Only” page after you complete the Registration Form below.    We will send you an email when your access is set up.  Please allow 2 days for your access to be processed.  You will have access to this page for 1 year from the date your registration. 

The Webinar Content will be in the form of a link to the streaming webinar recording and document files.  The forms are provided as a downloadable link.  We recommend you download the forms immediately.  We may revise the forms from time to time, so you may want to check the Webinar Member page occasionally for any updates.  We reserve the right to provide some content by email, if necessary. 

License Grant.  By purchasing the webinar, we grant you a limited license, which is non-exclusive, non-transferable, and non-sublicenseable, to access, view, and use the Webinar Content solely for your personal purposes. No Webinar Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, modified or used for public or commercial purposes, or downloaded in any way unless written permission is expressly granted by us. Modification of the Webinar Content or use of the Webinar Content, including the documents and forms, for any other purpose is a violation of our copyright and other proprietary rights and may be subject to monetary damages and penalties.

Confidentiality.  You agree to maintain the confidentiality of your password and are fully responsible for all liability and damages resulting from your failure to maintain that confidentiality and all activities that occur through the use of your password.  You agree to immediately notify us of any authorized use of your password or any other breach of security.

Disclaimer.  The webinar is intended to be educational and is not considered legal advice on its own. Therefore, you should not make decisions or take any actions or in-actions based solely on the webinar content.

Scheduling Your Consult.  After you watch the webinar, please email us at gwen@simonsassociateslaw.com to schedule your individualized consultation.  During that time, we will draft a customized payment agreement for you to use with your patients.

Consultation Disclaimer.  The individual consultation is intended to assist you in making decisions based on your own practice, including but not limited to whether to enroll with or continue as a Medicare participating or non-participating provider or disenroll, whether you will see Medicare patients who want to pay you privately for their covered or non-covered services, and what other policies you might need to put in place.  It is important for you to understand that the information in our webinar is based on our interpretation and analysis of the Medicare statutes, regulations and case law we reviewed.  There are unanswered questions in the case law, therefore, our analysis and opinion may change if new information becomes available or new case law is subsequently published.  Our intent is to advise you on the potential risks and how to minimize your risks if you decide to accept private payment from a Medicare beneficiary.  We do not claim that our advice will eliminate all potential legal and compliance risks, especially if you do not follow our advice or your patients try to submit their own claims to Medicare even though they agreed, of their own free will in writing, that they would not do so.  Therefore, you assume all risks, if any, if you choose to accept private payment from Medicare beneficiaries for covered or non-covered services whether you are enrolled as a Medicare provider or not.

Right to Terminate.  We reserve the right to limit your access to the Webinar Content should the we determine, in our sole discretion, that you have violated any of the prohibited uses or any other terms in this Agreement.
